Our policy on bulk unsolicited commercial e-mail (also known as SPAM)

If you send SPAM through our servers, you are liable for a charge of $10 per message.

Our policy on UCE/SPAM is pretty clear. We cannot tolerate it, either through our network or referencing customer websites.

We need customers to understand that every time they send out a bulk unsolicited e-mail, hundreds of reports are sent to their connectivity, e-mail and web-hosting providers reporting the violation.

These reports are not harmless. Currently, anti-spam vigilance is at an all-time high, and many online service subscribe to anti-spam blackhole lists, which actually block e-mail from networks where spamming services are supported. So if you spammed from one of our servers, and we did not act on the complaints received, it is likely that part or all of our network may be blocked from sending mail to many locations on the Internet (blackholed). So you can see how spamming activities impact more than just the spammer and the recipients of spam.

Q: If I'm not sending my UCE through your network, just referencing my website that you host, how does your UCE policy apply?

It applies equally. Because the act of sending UCE generates complaints (and netblock blacklists!) against directly responsible networks, upstream providers AND hosts of "spamvertized websites", we maintain a zero-tolerance policy on all of the above.

Summary: Pennyhost policy provides that we may shut down any sites or servers which are the source or cause of sufficient SPAM/UCE reports. In addition, SPAM/UCE which violates any state laws may be subject to prosecution and/or civil liability within those states.
